The norm that the Ministry of Equality plans to present to the Council of Ministers within a few days regulates the right to freely manifested gender identity, without the need to provide any medical or psychological diagnosis, and dedicates its chapter VI, article 39, to the measures to be adopted in the sports field

Regarding foreigners whose identification documents issued by the Spanish authorities have been appropriate to their gender identity, according to the future law, the rule states that they will be able to participate based on the sex that appears in those identification documents.

Last March the IOC announced that its guidelines on the eligibility of transgender athletes will remain in effect for Tokyo 2020, while it follows a consultation process regarding the inclusion of athletes based on their sexual characteristics and gender identity.

The consultation aims to “develop a framework and guidelines for athletes and international federations, which would be based on research data and the latest information from the scientific and human rights sectors.”

Since 2015 for the IOC, the eligibility of trans people in the female category requires that the athlete must have declared that their gender identity is female, without being able to change the declaration for a minimum of four years.

Athletes would also have to demonstrate that their total serum testosterone level has been below 10 nanograms per liter for at least 12 months prior to their first competition and throughout the desired period of eligibility to compete in the female category.
