At the end of last November, Mario Baudry became the first lawyer to be part of the case investigating the possible wrongful death of Diego Armando Maradona. He did it as a private victim, representative of Diego Fernando, the last heir to the greatest player of all time and as his mother’s lawyer, Verónica Ojeda.
Today, little more than two months later, the file instructed by the San Isidro prosecutors progressing their evidence collection to a medical board in charge of effectively resolve whether or not Diego suffered malpractice due to negligence or omission of the doctors who should treat him -which will be made up of specialists from the Procurator’s Expert Counsel together with the specialists proposed by the parties and even without a defined date- contains alarming information: the analysis of information on hijacked phones to the neurosurgeon Leopoldo Luque and the psychiatrist Agustina Cosachov, at least 400 gigabytes of information, show a portrait of their patient, refusing to treat basic symptoms while anticipating his autopsy months before his death.
There is also another story. The skills revealed a troubled Luque: his star patient, his loot of selfies On Instagram, the end environment gave him smoking marijuana. Diego asked for it, supposedly supplied by Charly, an indirect relative of his ex-partner, Rocío Oliva.
Thus, Baudry becomes in one of the most powerful figures of the cause, today at a midpoint: between the strong test and the race at the end of the charge.
“In the case there are all the elements to call Luque to an investigation,” says Baudry.

-Why did the environment give Maradona marijuana and alcohol?
-The truth, I don’t know. This arises from the expertise to the phones of Luque and Cosachov in addition to a presentation that we make. In fact it is denounced by Verónica; confirmed it in September of last year. Highlights the carelessness that was towards the figure of Diego in the last months that ended with his death.
For now, the medical board will be the one that resolves whether the cannabis use of the greatest idol in Argentine history was indeed part of the equation of his death, with a heart marked by microinfarcts. It’s unclear when marijuana ends in Diego’s story, but it is known when the medication starts. What Baudry reveals is extremely striking: “They do it after being admitted to the Ipensa clinic, where Diego only goes to have a check-up. The next day, Luque says that he needs an operation because he had to remove the gases from the inflammation he had. There, they take him to the Olivos Clinic for surgery. After Diego passed away, we learned that his condition was inoperable and that they had also recommended not to operate on him. Also, that the one who had operated on him had not been Luque. I mean, Luque lied to us ”.
Baudry, for now, was not notified of the start of the medical meeting nor could it contribute up to now to its specialists.

The lawyer sees another storm front on the horizon: Matías Morla, whom Luque is believed to have responded to or reported, is also a lawyer in the case. Baudry does not believe that Maradona’s latest attorney can be charged with a crime, not because of the evidence. “No element comes up, I don’t know what the prosecutors will find later.” Sources in the San Isidro courts assure that the accusation, in a current working hypothesis, would not extend beyond those in charge of the immediate first line of defense to take care of Diego’s health, whether they are medical personnel or not, something Baudry agrees on.
The nurse Dahiana Madrid, present on the day of death, who stated that he lied in a report at the request of his boss, “He had the courage to tell the truth, he came and told us”, says the lawyer: “The cause is gaining momentum because he came to tell me and Veronica when everyone was hiding the truth.”
Morla, Baudry says, knew about Charly and about marijuana. “I was aware that there were drugs in Diego’s house, but it does not merit medical responsibility”, dice.
In parallel, there is the dispute over the inheritance, of which Dieguito Fernando is a part as Maradona’s natural son. Baudry assures that There is no equity calculation, that only some cars were counted, that the inventory of goods from Dubai, 250 in total, is little compared to what Verónica Ojeda knows, that Morla and her lawyer say “many things.” The dispute over the money of the future is a more difficult question.
On December 23, less than a month after Maradona’s death, the Official Gazette reflected the composition of the board of directors of Sattvica, the firm that between 2016 and 2018 concentrated in its power all the brands of Maradona’s image: his own name in all its popular variants, “El Diez”, “La Mano de Dios”. Morla is its president, Maximiliano Pomargo, his brother-in-law, alternate director. There are more than 170 minutes in the records of the National Institute of Intellectual Property that reflect how Maradona became the transferor of his own legend. The licensing potential is almost limitless – from video games to lottery scratch cards.
Argentine law establishes that trademarks are attributable and it is at least difficult for the heirs of the person who generated that trademark to dispute them. Baudry knows it, but he also raises the chance that Maradona has not signed for these assignments, given the alleged falsification of Luque’s signature, of procedures allegedly carried out with “a power of attorney.” The lawyer, for now, assures that he managed to block in favor of the heirs a procedure in Europe for Sattvica to operate with the Diego Armando Maradona brand.

-How do Dieguito Fernando and Verónica process death?
-Bad, as they find out about everything Diego was going through and that Diego didn’t count. It happened to Verónica every time he went with Dieguito and it happened to his other children who went to see him and he was drunk in an armchair. And there I did not want to be like this. One day Verónica took Dieguito, Maradona was feeling very good, he was waiting for one of the daughters who was coming in the afternoon and began to drink her soup. He drank it with a glass of wine, two centimeters, because he did not want to drink so as not to be with his children. He finished the drink and was drunk on the couch. Later we found out that they were the medications they gave him. He got into a fight with one of the daughters over this, who asked him why he was drunk. This is part of everything that can come out in an oral trial, part of human miseries.
-Do you see a very difficult judgment ahead? With juries?
-I hope it is by juries, so that people can express their opinion. It’s going to be very hard, not because of the technical aspects, because of the proven things, but because of how degrading they treated Diego in the last half. It will be very hard for the family, for the people, when they know all the things that Diego suffered and that he did not deserve to suffer.
-What did Verónica Ojeda de Luque think in the months before her death? What did you know about what happened in the country house? Or what did they let him know?
-When he was admitted to Ipensa, Luque called Verónica because he did not dare to tell Diego that he had to have a check-up. It is Verónica who convinces him. What he never knew is that they operated on Maradona for something that they did not have to operate on. From there, Verónica is not allowed in anymore. You can’t see it anymore. Diego calls her, talks to Verónica, angry because he had not taken Dieguito to the clinic. “But I just got back and they didn’t let me in,” he replied. There was always an excuse, the last one was for COVID, which was not true because there were several people in Diego’s room. The other daughters and Luque would not let her in.
-What is Dieguito asking today?
-Ask why his dad died, why did he have to die. For him he was not his idol, he does not know that he was a great player. It was his dad. On Diego’s birthday, a man very kindly gave Dieguito a shirt on the gymnastics court. He ran to show it to his dad. I was happy. I did not know that Diego was a soccer idol. At that moment they were both happy.
